  Terms and Conditions for Use of the Club Boat

  • The MHASC Club boat is provided by NB Laser and is available to members and visitors as approved by the Commodore, Vice-Commodore or Secretary/Treasurer.
  • In approving the use of the Club Boat neither the Club nor its officers provide any warranty as to the condition of the boat. Users must satisfy themselves that the boat is seaworthy and fit for the purposes for which they intend to use it.
  • Neither MHASC nor NB Laser accept any responsibility whatsoever for any loss, damage or injury which may be sustained as a result of the use of the MHASC Club Boat, or any of the equipment made available by MHASC.
  • Neither MHASC nor NB Laser accept any responsibility for any loss, damage or injury which may be caused either directly or indirectly by any failure of any of the equipment provided with the MHASC Club Boat, including for example but not limited to its spars, ropes, sails, hull, rudder, tiller or tiller extension, centreboard and blocks.
  • MHASC is not able to assess whether users are competent handle the Club Boat in the range of sailing conditions and circumstances that may be experienced on Sydney Harbour. Users warrant that they are competent to handle the boat in the prevailing and potential conditions.
  • Users undertake to report any equipment failures or maintenance requirements. Where damage is caused as result of user actions, the user undertakes to assist with repair actions if requested to do so.
  • Users acknowledge that the Club does not and cannot provide dedicated rescue facilities. If the Club Boat is used for Club racing attention is drawn to Racing Rules of Sailing, (RRS) Rule 4 Decision to Race: The responsibility for a boat’s decision to participate in a race, or to continue racing, is hers alone.
